Legal_Terms_Title
Draft notice: this Terms of Service was drafted as a starting point for JobEase's V1 release (docs/V1_DELIVERY_PLAN.md Phase 8). It is not legal advice and must be reviewed and approved by a qualified legal professional before this application is used with real customers or real payment data.
1. Who these terms apply to
These Terms of Service govern use of JobEase by service providers ("Provider") who create an account to manage clients, jobs, and invoices, and by the consumers ("Client") that a Provider invites into their JobEase workspace.
2. The service
JobEase is a multi-tenant scheduling, client-management, and invoicing application. Each Provider's data is isolated from every other Provider's data; a Client's access is limited to the Provider relationship(s) they hold an active membership in.
3. Accounts and acceptable use
- You are responsible for the accuracy of information you enter and for safeguarding your account credentials.
- You must not attempt to access another Provider's tenant, another Client's data, or any account you are not authorized to use.
- You must not use the service for unlawful purposes or to store data you do not have the right to store.
4. Jobs, clients, and invoices
Providers are solely responsible for the accuracy of job records, client contact information, and invoice amounts they create. JobEase provides the tools to record and track this information; it does not verify the underlying business transactions.
5. Payments
Where online payment processing is enabled, card data is handled directly by our payment processor (Stripe) and is never stored by JobEase. Manually marking an invoice as paid is a Provider-entered record and is not, by itself, proof of payment receipt.
6. Data location and retention
Customer data is resident in Canada. Data is retained for as long as your account is active, plus any additional period required by applicable law; see the Privacy Policy for detail.
7. Termination
Either party may stop using the service at any time. We may suspend or terminate an account for a violation of these terms, including attempted unauthorized cross-tenant access.
8. Fees and subscription
Where a paid subscription tier is offered, its price, billing frequency, and included features will be shown before you subscribe. Fees are processed by Stripe and are non-refundable except where required by law or stated otherwise at the time of purchase.
9. Disclaimer of warranties and limitation of liability
The service is provided "as is," without warranties of any kind, to the maximum extent permitted by law. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the service; our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.
10. Governing law
These terms are governed by the laws of Canada and the province in which the operating entity is registered, without regard to conflict-of-law rules. [Operator: confirm the specific province once the business entity is registered.]
11. Changes to these terms
We may update these terms as the product evolves. Material changes will be reflected by an updated "Last updated" date above.
